The last twenty-five years of published literature and curriculum development in bioethics suggest that the field enjoys a successful and stable marriage to philosophical ethical theory. However, the next twenty-five years could be very different. I believe the marriage is troubled. Divorce is conceivable and perhaps likely. The most philosophical parts of bioethics may retreat to philosophy departments, while bioethics continues on its current course toward a more interdisciplinary and practical field.I make no presumption that bioethics is integrally linked to (...) philosophical ethical theory. Indeed, I assume that the connection is contingent and fragile. Many individuals in law, theological ethics, political theory, the social and behavioral sciences, and the health professions carefully address mainstream issues of bioethics without finding ethical theory essential or breathtakingly attractive. Professor Mclntyre's imaginative and constructive paper has three primary (...) parts (despite its division into six sections). First, she offers an interpretation of Hume's view of the self in Book I of the Treatise. Second, she explains why his own reservations in the Appendix create problems not only for this theory of self identity but for other parts of his philosophy as well. Finally, she tries to ease him out of these difficulties with her overlap interpretation of the bundle theory. My comments follow exactly this outline, though my conclusions, for the most part, do not coincide with hers. My reservations do not derive from her attempt to render Hume consistent. Rather, I question the foundations of the entire enterprise in which she, Robison, Nathanson, et. al. are engaged. That is, I remain unconvinced that the alleged problem, as presently framed, is more than a pseudo-problem. I. Hume's Theory in Book I In Book I Hume offers a variety of arguments about the nature of the self, most of which rely on other theories, such as those of causation, the association of ideas, and substance. Whatever the exact arguments and positions he may be advancing, at least the following six propositions are integral to his theory of personal identity: 1)The self is entirely reducible to a collection of perceptions. 2)The self is not characterized by strict identity. 3)There is nothing simple in which the collection of perceptions inheres. 4)Both identity and simplicity are attributed to the self because of relations between perceptions--the relations of causation and resemblance. 5)The relations of resemblance and causation unite these perceptions. 38. 6) There are no real (non-associational) connections or relations among these perceptions which unite them. Half of these six claims are critical denials of other philosophical claims; the other half are constructive philosophical theories. Hume's entire philosophical program in Book I is tied up with these claims. The criticisms are directed at numerous metaphysical theories of mind, substance and causation; and the constructive account of personai identity requires his theories of perception and association of ideas. I mention these obvious points only because it is so important to note that if_ the interpretation is correct which Professor Mclntyre and others give to (roughly) five sentences in the Appendix, where Hume mentions a possible inconsistency, then Hume is not only questioning his theory of personal identity in Book I, he is calling Book I itself into question. To be convinced that this strikingly implausible turnabout occurs in five sentences of the Appendix, we must be given a most compelling argument—one which I doubt is forthcoming. II. Hume's Alleged Inconsistency The alleged problem of inconsistency arises because Hume says in the Appendix that he does not know how to render his own former opinions consistent (T633, 636). However, when he comes to a formal statement of the inconsistency, as everyone is agreed, the propositions said to be inconsistent are not inconsistent. In the attempt to grasp Hume's meaning, a general consensus has emerged in recent Hume scholarship, including Professor Mclntyre in its company, that we ought both to move backward and forward a sentence or two in Hume's text. What grounds and justifies conclusions in medical ethics? Is the source external or internal to medicine? Thee influential types of answer have appeared in recent literature: an internal account, an external account, and a mixed internal / external account. The first defends an ethic derived from either the ends of medicine or professional practice standards. The second maintains that precepts in medical ethics rely upon and require justification by external standards such as those of public opinion, law, religious ethics, or (...) philosophical ethics. The third claims that distinct medical ethics have emerged from distinct cultural frameworks, each with norms that govern physicians. There is merit in each perspective, but each overreaches its supporting arguments and fails to appreciate what is legitimate in the theses of its competitors. I propose a fourth account that offers a way to escape limitations of the other three, while retaining their most attractive features. (shrink)

This article presents an original interpretation of David Hume’s eighteenth-century writings in moral philosophy as universalistic and normative, and not as merely psychological, metaethical, empirical, and the like, which has been common in many interpretations of Hume. Whether his views should or should not be regarded as a type of general moral theory such as utilitarianism is not considered, although I argue that Hume is deeply committed to a form of virtue ethics. I also argue that Hume sees the fundamentals (...) of morality as a human phenomenon that is universally applicable to, and universally shared across, cultures and geographical regions. In this way Hume relies heavily on his conception of a universally shared common morality, which he refers to as the morality present “in common life.” This morality is a major foundation of his moral philosophy. In this essay, I describe Bob Veatch’s career from the perspective of a colleague and friend. Bob and I started our professional careers at the same time and quickly came into professional contact. With Bob’s move from the Hastings Center to the Kennedy Institute, we became colleagues and worked for almost a decade on our book on death and dying. He was an outstanding co-editor and author. I believe he knew more about the philosophically connected issues in this area of (...) bioethics than anyone publishing in the area, and it was an area of intellectual interest that he pursued throughout his career. Beyond bioethics, Bob and I shared our shared love of contemporary bluegrass music, especially the songs of The Seldom Scene. Bob studied them much as he studied bioethics—with deep knowledge and seriousness. He was just a scholar by nature and with excellent training and experience. If we were to create a Hall of Fame for bioethics, Bob might be the first person elected. (shrink)

Chris Durante’s comments on my article about the compatibility of universal morality, particular moralities and multiculturalism indicate that we have very different approaches to and understandings of these three notions. Durante investigates multiculturalism from the perspective of political philosophy, whereas my approach is grounded in moral rather than political philosophy. Since he refers to his framework as an ‘ethico-political theory’, he may regard his account as a synthesis of moral and political philosophy, but this representation seems incorrect. He repeatedly refers (...) to his discussions of multiculturalism using the language of ‘political ethics’, ‘political theory’, ‘political philosophy’, ‘political system’, ‘political ramifications’, ‘political order’, ‘political liberalism’, ‘political community’, ‘political society’, ‘political principles’ and related concepts. He bluntly states his view about the centrality of political theory: ‘Multiculturalism…is primarily concerned with establishing a political system with moral undertones rather than a moral system with political ramifications’. I take the reverse view. Durante assumes without argument that multiculturalism finds its origins and home in political philosophy; by contrast, I envision multiculturalism as primarily a moral theory about obligations to tolerate moral differences in the face of conflicts between cultural groups. Hume notoriously maintains that contiguity, succession, and constant conjunction are individually necessary and jointly sufficient conditions of causation. While his arguments for the necessity of constant conjunction have been thoroughly dissected, his arguments for contiguity and succession have generally been either ignored or misstated. I hope both to correct this unfortunate state of affairs and to show some fatal defects in Hume's account.The pertinent passages in Hume's writings acknowledge three conceivable ways in which the temporal relation between causes and effects (...) might be construed: as separated by some interval; as perfectly contiguous, so that the effect succeeds the cause in the very next moment; as perfectly contemporaneous, existing at the same moment. This autobiographical sketch is being published 50 years after I started as an assistant professor at Georgetown University in 1970. In this presentation, I cannot tell the full story of these 50 years. I write only about the formative years both before and after I was hired at Georgetown, and I emphasize two subjects. The first is the importance of the individuals who were massive influences on my intellectual development and aspirations. The second is the great importance of multidisciplinary work. (...) I came from philosophy, a discipline that generally did not emphasize or particularly value multidisciplinary work, but I was transformed by individuals in other disciplines who directed me to this style of work. To find out what those questions are in the UK, representatives from 28 organizations involved in policy, together with scientists from 10 academic institutions, were asked to generate a list of questions from their organizations. 2 During a 2-day workshop the initial list of 1003 questions generated from consulting at least 654 policy makers and academics was used as a basis for (...) generating a short list of 100 questions of significant policy relevance. Short-listing was decided on the basis of the preferences of the representatives from the policy-led organizations. 3 The areas covered included most major issues of environmental concern in the UK, including agriculture, marine fisheries, climate change, ecosystem function and land management. 4 The most striking outcome was the preference for general questions rather than narrow ones. The reason is that policy is driven by broad issues rather than specific ones. In contrast, scientists are frequently best equipped to answer specific questions. This means that it may be necessary to extract the underpinning specific question before researchers can proceed. 5 Synthesis and applications. Greater communication between policy makers and scientists is required in order to ensure that applied ecologists are dealing with issues in a way that can feed into policy. This report had been requested in May 1997 by the Department of Health and Human Services (DHHS). We will here describe the genesis of the IOM (...) report, the medical and moral concerns that led the DHHS to sponsor it, the process of producing it, and its conclusions. The analyses, findings, and recommendations of the report are also reviewed, in particular the central issues that led to suggestions for policy changes.Transplantation BackgroundAs a first step, some background in the relevant aspects of organ transplantation will prove useful. For the purposes of this analysis, “transplantation” involves the transfer of cells, tissues, or solid organs from one human to another to replace the structure or function of comparable body components that, through injury or disease, are defective or of inadequate function. The IOM report deals with solid organs, primarily kidneys and livers, whose blood supply is reconnected in the organ recipient, in contrast to cells, like bone marrow, and tissues, like corneas. A variety of donor types exists for organ transplantation, each with particular medical and scientific conditions.Living donors are healthy (and usually genetically related) individuals who volunteer to provide either a whole, paired organ such as a kidney or a section of an organ such as a liver. Cadaver donors are individuals who have died and from whom a full array of organs can be taken. “Heart-beating” cadaver donors are individuals who have suffered “brain death,” that is, irreversible cessation of function of the whole brain including the brain stem; and “non-heart-beating” donors (NHBDs) are individuals who are ill or injured, but not “brain dead,” and who have suffered cardiopulmonary death, that is, irreversible cessation of cardiac and respiratory function. NHBDs can be “controlled,” which means that [End Page 83] they can be sustained by artificial life support systems until a medical and family decision is made to terminate futile life support. This can be done at a scheduled time and in a controlled manner, and organs can then be recovered for transplantation. NHBDs can also be “uncontrolled,” which means that their hearts and breathing have stopped through disease or injury at an unexpected time or in an uncontrolled manner, and they cannot be resuscitated; the organs of some individuals of this description can be recovered for transplantation. Cloth, $120.00.This book reopens the question of the correct interpretation of 'cogito, ergo sum,' and considers the significance of Descartes's first principle for Western philosophy up to and including the twentieth century. The gist of Miles's interpretation is (...) captured in the first three words of his title. The cogito is both insight and inference. How is it an inference, exactly? In the course of a process of selective attention to elements of thought, the cogito brings each person to the explicit knowledge of the fact of his or her existence (49). We have an implicit grasp of what the cogito makes explicit; and the passage from implicit to explicit knowledge amounts to a kind of inference. It is like an Aristotelian induction (cf. chapter 20).Inference is the topic of Part Three. Part Two concerns certainty. The cogito is certain in Meditation Two not in the light of the thought that God is veracious, but in the light solely of reflection on one's actually occurring thoughts (47). As for what Cartesian thoughts are, Miles seems to suggest that they are rather like what Husserl gets out of his phenomenological reduction: "intentionally-structured or object-directed acts of thinking" that are the sole immediate objects of consciousness (45). This book sets out to reconfigure the metaphors that have dominated investigation since the advent of print-culture and the Columbian voyages. Adventure, quest, risk, discovery: Francis Bacon’s analogy of scientific research (...) to oceanic travel established the stereotypes that Ulmer strives to dismantle. In 1962 Claude Lévi-Strauss noted in The Raw and the Cooked that in our time: “It is no longer a question of sailing toward other lands: only the voyage is real, not the earth, and the routes have been replaced by the rules of navigation.” With the advent of hypermedia, creation becomes an art of selection and combination. Truth gives way to discovery. Creation is likened to a programmed mélange of material ordered by negotiation, intuition, and strategy.Ulmer performs his proof—and proves his performance—by constructing a virtual staging of a multilayered commemoration he fashions from cinema, architecture, Jacques Derrida’s oeuvre, American history, and autobiography. The result is a collage of signifiers that apposes literary theory, memory-arts, Gary Cooper’s persona in Beau Geste (dir. William Wellman, 1939), Columbian voyages, Platonic dialogues, and a canon of postmodern writings. Ulmer divides the book into four parts, the first of which crafts the overall method from Cartesian reason and Surrealist practices of juxtaposition and automatism. Part two offers a dynamic definition of choreography, the study of local, inherited, and originary areas in which subjectivity is born. In part three Ulmer [End Page 147] sets forth textual rehearsals, based on Lee Strasner’s Method (via Stanislavsky), that mobilize the space and time of his chosen materials. Part four, “Yellowstone Desert,” bring together the strands of the narrative embroidery into a gag-joke (a “puncept” on Custer and custard) that explodes in the author’s face.A good deal of the work turns on Ulmer’s treatment of chora. Exploiting its signifying potential (chora, corps, choral, chorus, coral) he discovers that the myth of the world’s creation recounted in the Timaeus begins when the demiurge makes an X from two strands of plasma. The chi is folded as colures of a sphere that becomes the globe. Nonetheless the presence of the self as an unknown (x) is inferred (in I, or ich). Ulmer shows that “in subordinating mystery to memory, and arguments to paradigms,” choreography will “engage the users’ premises in the process of learning, opening a mutually transforming circuit between judgment and theory, and hence affect not only (...) institutional practices (...) but human subjectivation as well” (p. 202). Patterned constructions replace the creation and resolution of enigmas. Hypermedia becomes the technology of new creation, while choreography comprises “the institutional practice for augmenting the intuitions of inference, for writing with the logic of the unconscious” (p. 224).Heuretics extends the field of play staked out in Ulmer’s Teletheory. Here is offered a scheme for creating multileveled texts that are both creative and critical and infinitely generative, and that invite readers to connect electronic media to the unconscious. Most readers will not fail to appreciate the wit of the exposition and the clarity of the creative method. Others will pause over some of its assumptions. Certain critical paradigms, such as the antithetical ontologies of Lacan and Derrida, appear easily reconciled. The unnameable traumas of history (genocide) and psychogenesis (the birth and growth of subjectivity) are glossed with an effortless art of citation (pp. 114, 233). The unconscious is assimilated into an easily “accessed” logic, the latter effortlessly “logging in” to the former. The redesign of the Columbian quincentenary indirectly ratifies some of the modes of control that flexible capitalism seeks to impose upon the unconscious. I develop a notion of nonlinear stochastic integrals for hyperfinite Lévy processes and use it to find exact formulas for expressions which are intuitively of the form $\sum_{s=0}^t\phi(\omega,dl_{s},s)$ and $\prod_{s=0}^t\psi(\omega,dl_{s},s)$ , where l is a Lévy process. These formulas are then applied to geometric Lévy processes, infinitesimal transformations of hyperfinite Lévy processes, and to minimal martingale measures. Some of the central concepts and results are closely related to those found in S. Cohen’s work on stochastic calculus for processes with jumps (...) on manifolds, and the paper may be regarded as a reworking of his ideas in a different setting and with totally different techniques. Most normally developing children acquire ToM between the ages of 3 and 5 years, but serious delays beyond this chronological and mental age have been observed in children with autism, as well as in those with severe sensory impairments. We examine data from studies (...) of ToM in normally developing children and those with deafness, blindness, autism and Williams syndrome, as well as data from lower primates, in a search for answers to key theoretical questions concerning the origins, nature and representation of knowledge about the mind. In answer to these, we offer a framework according to which ToM is jointly dependent upon language and social experience, and is produced by a conjunction of language acquisition with children's growing social understanding, acquired through conversation and interaction with others. We argue that adequate language and adequate social skills are jointly causally sufficient, and individually causally necessary, for producing ToM. Thus our account supports a social developmental theory of the genesis of human cognition, inspired by the work of Sellars and Vygotsky.How are we to decide whether to take reason to be an essentially private thing that can, however, turn on a public display when it chooses to do so, or, like conversing, to be an essentially social skill, which can, however, be retained a while through periods of solitary confinement? .The squirrel does not infer by induction that it is going to need stores next winter as well .The problem of thought and language thus extends beyond the limits of natural science and becomes the focal problem of historical human psychology, i.e. of social psychology. Consequently, it must be posed in a different way .From the very first days of the child's development his activities acquire a meaning of their own in a system of social behaviour and, being directed towards a definite purpose, are refracted through the prism of the child's environment. The path from object to child and from child to object passes through another person. In the seventh and most recent edition of their classic book, Principles of Biomedical Ethics, Tom Beauchamp and James Childress define a virtue as a character trait that is “socially valuable and reliably present” and a moral virtue as such a trait that is also both “dispositional” and “morally valuable”. The virtues that they single out as “focal” within biomedical ethics are compassion, discernment, trustworthiness, integrity, and conscientiousness. Not all is well in their treatment of virtue. Beauchamp and Childress seem (...) to worry that an ethical theory in which virtues are fundamental will neglect duties, rights, and societal needs. Further, they insist that there is no reason to think that, within ethical theory, one family of ethical concepts is the most important, nor that one theoretical approach is correct, or even superior to others. I will try to show, that there are strong reasons to see language, concepts, and matters of virtue as fundamental within normative ethical theory, both generally and in such specialized subareas as medical ethics. These reasons reveal themselves when we analyze concepts at the core of the alternative approaches to theorizing ethics that Beauchamp and Childress identify. (shrink)

When I wrote “The Case Against bGH” in the late 1980s, I enjoyed eating meat, enjoyed serving it to my family, and believed one could simultaneously defend traditional family farms and the welfare of animals. Shortly after finishing that article, I read again, and more carefully, Tom Regan’s The Case for Animal Rights. 2 Regan’s arguments challenged my presuppositions.

Several intrinsic/extrinsic distinctions amongst properties, current in the literature, are discussed and contrasted. The proponents of such distinctions tend to present them as competing, but it is suggested here that at least three of the relevant distinctions (including here that between non-relational and relational properties) arise out of separate perfectly legitimate intuitive considerations: though of course different proposed explications of the informal distinctions involved in any one case may well conflict. Special attention is paid to the question of whether a (...) single notion of property is capable of supporting the various distinctions. (shrink)

This paper is a complement to the recent wealth of literature suggesting a strong philosophical relationship between artificial life (A-Life) and artificial intelligence (AI). I seek to point out where this analogy seems to break down, or where it would lead us to draw incorrect conclusions about the philosophical situation of A-Life. First, I sketch a thought experiment (based on the work of Tom Ray) that suggests how a certain subset of A-Life experiments should be evaluated. In doing so, I (...) suggest that treating A-Life experiments as if they were just AI experiments applied to a new domain may lead us to see problems (like Searle’s “Chinese room”) which do not exist. In the second half of the paper, I examine the reasons for suggesting that there is a philosophical relationship between the two fields. I characterize the strong thesis for a translation of AI concepts, metaphors, and arguments into A-Life as the “global replacement strategy.” Such a strategy is only fruitful inasmuch as there is a strong analogy between AI and A-Life. I conclude the paper with a discussion of two areas where such a strong analogy seems to break down. These areas relate to eliminative materialism and the lack of a “subjective” element in biology. I conclude that the burden of proof lies with the person who wishes to import a concept from another discipline into A-Life, even if that other discipline is AI. (shrink)
